Terms of Use

These terms govern your use of kincyindustries.com, which is run by Kincy Heavy Industries Corporation ("KHI", "we", "us"). By using the site you accept them. If you do not accept them, please do not use the site.

These terms cover the website only. A pilot, partnership or any other work with KHI is governed by a separate written agreement signed by both sides. Nothing on this site, and nothing you send us, creates one.

What the site is for

The site describes Bishop, Bishop CORE and MUTHR, which are under development. It is information. It is not advice, and it is not an offer to sell anything.

Everything shown running on this site is illustrative. The site view, the terminal session, the pump, chiller, server hall and lease in them, the 3D models, the film and every reading, timing and number they show are a simulated scenario built to explain the idea. They are not a customer's data and not a prediction about your operation. Bishop CORE is shown as conceptual hardware, not a final product or specification. Any of it can change without notice. Do not rely on anything here for a design, engineering, safety, operational or purchasing decision.

Using the site

You may read the site, and print or save pages of it, for your own use and to decide whether to work with us. You may not:

• copy, republish or redistribute the site or a substantial part of it
• frame it, or present any of it as your own
• scrape it, mine it or extract it systematically by automated means
• probe, scan or test its security, or try to reach anything not deliberately published
• interfere with the site or with anyone else's use of it
• use it unlawfully, or to send anything unlawful to us

What belongs to whom

The site and its content, including its text, design, code, 3D models, film and images, and the names and logos shown on it, belong to Kincy Heavy Industries Corporation or its licensors. These terms give you no license to any of them beyond reading the site. Open-source components are used under their own licenses.

What you send us

If you send us an enquiry, everything in it that is yours stays yours. You give us permission to read it, keep it and use it to answer you and to consider possible work, as the Privacy Policy describes.

Please do not send confidential information before a confidentiality agreement is in place. Until then we cannot treat an unsolicited message as confidential, although we will handle it with care and will not publish it.

The site is provided as it is

The site is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title or non-infringement. We do not warrant that the site will be uninterrupted, error free or free of harmful components, or that anything on it is complete or current.

Liability

To the fullest extent the law allows, Kincy Heavy Industries Corporation and the people who work for it are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, goodwill or business opportunity, arising out of your use of this site, however caused.

Our total liability to you for everything connected with this site is limited to one hundred United States dollars.

Nothing in these terms limits liability that cannot be limited by law, including liability for fraud.

Indemnity

If your use of the site breaks these terms or the law, and that brings a claim against us, you will cover our reasonable losses and costs arising from it.

Changing or suspending the site

We may change, suspend or withdraw the site, or any part of it, at any time. We may also stop a particular person using it if they break these terms.

Governing law

These terms, and any dispute arising out of them or out of this site, are governed by the laws of the State of Texas, United States, without regard to its conflict of laws rules. The state and federal courts located in Texas have exclusive jurisdiction, and you agree to that jurisdiction and venue.

General

If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a term straight away, we have not waived it. These terms, together with the Privacy Policy, are the whole agreement between you and us about the site.

Changes

If these terms change, the date at the top changes with it. Using the site after that means you accept the version then published.
